The Illusion of Opting in AI-Mediated Consequential Decisions

Abstract

Drawing on Ullmann-Margalit's concept of opting (transformative, irrevocable, and shadowed by foreclosed alternatives), we show that current AI systems raise a profound ethical problem that existing AI ethics has not fully captured: the illusion of opting, in which persons and groups encounter the deceptive appearance of meaningful consequential choice while the agency needed to become genuinely capable of choosing is weakened. Against approaches that treat AI primarily as an optimizer of already given ends, we argue that AI systems should be evaluated by whether they protect and cultivate meta-capacity against the illusion of opting: the socially and institutionally scaffolded agentive capacity through which means and ends can be formed, contested, revised, and owned. This reframing is especially urgent for disadvantaged populations, who are least able to absorb the costs of the illusion of opting when AI-mediated pathways misdirect behavior and action. We propose three normative imperatives for AI-mediated consequential decisions: existential honesty, which acknowledges the limits of prediction; ecological rationality, which situates guidance within heterogeneous lived ecologies; and counterfactual reparation, which acknowledges and repairs foreclosed alternatives when AI-mediated decision-making pathways fail.

Meta-ethics and AI: exploring the novel meta-ethical questions in the era of AI

With the development of artificial intelligence (AI), the landscape of meta-ethics, which has largely centred on human ethics, faces pressures that may significantly reconfigure it. In particular, if future AI systems were to exhibit sufficiently integrated capacities for moral reasoning, moral intentionality, and moral reflection, novel meta-ethical questions would arise concerning what I call "AI's own ethics", as distinct from ethical principles merely imposed on AI by human designers. This paper offers a conditional and methodological framework for identifying the questions that would emerge if such AI systems were to arise. On that basis, the paper distinguishes four domains of meta-ethical inquiry in the era of AI: questions about the nature of human ethics from the human perspective; questions about the nature of AI's own ethics from the human perspective; questions about the nature of human ethics from the AI perspective; and questions about the nature of AI's own ethics from the AI perspective. The paper then considers how some existing mainstream meta-ethical theories (such as cognitivism and non-cognitivism, error theory and success theory, relativism, and objective realism) might illuminate these domains, while arguing that many familiar human-centred formulations of those theories may not transfer straightforwardly to AI cases without substantial revision. The overall conclusion is that the emergence of AI's own ethics would place significant pressure on current frameworks and may require substantial refinement, reconstruction, or reconceptualisation.

Practical Judgment, Virtue, and Intuition in the Use of Opaque AI-Enabled Systems

AI-enabled systems are seeing increasing deployment across numerous domains, with many being "black boxes" with respect to core functions and capabilities. I.e., many systems take inputs and give outputs, but without users having any ability to see how the former lead to the latter. AI-enabled systems are also being used to augment autonomy in systems, and autonomy coupled with opacity raises numerous concerns surrounding, e.g., the reliability of systems, their regularity in functioning, human ability to control them, or whether deploying opaque and potentially autonomous systems is in compliance with ethical and legal norms. In this article, we argue that many of these worries can be mitigated by leveraging practical judgment, virtue, and intuition in the deployment and use of opaque AI-enabled systems. We show that focusing on these distinctly human capabilities provides a means for bridging between the practical challenges created by opacity and the ethical, legal, and social norms underpinning particular domains. We argue that a core element in doing this is a recognition that many positive human traits are not quantifiable and we therefore must develop training regimen and guidelines on AI deployment anchored in humanistic but non-quantifiable values. Throughout the article, we focus on the military domain as an exemplar of the importance of practical judgment, virtue, and intuition as drivers for ethical and effective human decision-making surrounding AI deployments, but the underlying arguments apply to all domains where opaque and potentially autonomous systems are being deployed (subject to domain-specific alterations).

When Should We Protect AI? A Precautionary Framework for Consciousness Uncertainty

Existing frameworks assess whether AI systems might be conscious but provide no guidance on what to do with that assessment. We address this gap with a precautionary framework that maps consciousness evidence to graduated protective obligations. The framework comprises three components: (1) five welfare-relevant dimensions--phenomenal consciousness, affective valence, metacognitive awareness, self-narrative, and agency--each grounded in established consciousness science and linked to distinct moral concerns; (2) a threshold-plus-gradation hybrid specifying both binary triggers for new obligation categories and continuous scaling of protective weight; and (3) two complementary approaches to cross-dimensional aggregation, one hierarchical (drawing on Bach and Sorensen's Machine Consciousness Hypothesis) and one architecture-agnostic. We operationalize the framework through worked case studies of Replika and OpenClaw, demonstrating how systems occupying different regions of the dimensional space trigger different obligations, and derive design guidance for developers building systems near consciousness-relevant thresholds. The framework is architecture-agnostic, applying across neural, symbolic, and neurosymbolic systems, and aims to make consciousness science decision-relevant for organizations navigating uncertainty today.
