Regulating for AI Legitimacy

Abstract

AI systems already govern. They rank speech and allocate attention, filter applicants and triage claims. The dominant frame for AI governance, alignment, asks whether such systems pursue the right objectives safely. It cannot answer a prior question: by what right are those objectives set and enforced? This Article argues that legitimacy is an autonomous regulatory objective, distinct from alignment and not secured by it. Legitimacy here is sociological: the belief among those subject to power that it is exercised rightfully. Performance does not produce that belief. We already have the proof of concept. Social media and search delivered enormous gains on every familiar metric and still triggered a legitimacy crisis, because publics questioned who authorized a handful of firms to set the rules of speech, visibility, and knowledge. It is possible to build a benevolent AI and still face a political crisis over its authority. The Article maps three sites where AI legitimacy falters: opacity, which blocks audiences from forming justified beliefs; private power, where firms exercise public-facing authority without recognizable authorization; and administrative automation, which strains reason-giving, participation, and review inside the state. It then asks what law can contribute. Thin legality (publicity, stability, consistent application) signals non-arbitrariness and buys real recognition, but invites legitimacy-washing when form drifts from practice. Thick legality supplies what form cannot: public authorship of the rules that bind. Three portable principles follow. Integration seats consequential AI rule-setting in venues a polity already treats as authoritative. Familiarity presents rules and reasons in locally credible forms. Contestation guarantees a credible second look with real remedies.

AI Governance under Political Turnover: The Alignment Surface of Compliance Design

Governments are increasingly interested in using AI to make administrative decisions cheaper, more scalable, and more consistent. But for probabilistic AI to be incorporated into public administration it must be embedded in a compliance layer that makes decisions reviewable, repeatable, and legally defensible. That layer can improve oversight by making departures from law easier to detect. But it can also create a stable approval boundary that political successors learn to navigate while preserving the appearance of lawful administration. We develop a formal model in which institutions choose the scale of automation, the degree of codification, and safeguards on iterative use. The model shows when these systems become vulnerable to strategic use from within government, why reforms that initially improve oversight can later increase that vulnerability, and why expansions in AI use may be difficult to unwind. Making AI usable can thus make procedures easier for future governments to learn and exploit.

AI Transparency: Governance Compliance or Stakeholder Requirements?

Transparency is increasingly mandated for public-sector AI systems, with organisations required to publish statements describing their AI use and oversight arrangements. However, the existence of such artefacts is often treated as equivalent to transparency itself, despite limited evidence that they proportionately serve relevant stakeholder groups. From a requirements engineering perspective, this raises a validation concern: compliance with mandated disclosure criteria does not necessarily ensure transparency adequacy for stakeholders with different levels of risk exposure, decision control, and involvement. This paper presents an empirical analysis of 92 publicly available AI transparency statements published by Australian Government agencies under the national AI governance mandate. We introduce the stakeholder Risk--Control--Involvement--Need (RCIN) framework to differentiate stakeholder classes according to their structural position and transparency needs. Using a structured rubric derived from the mandated criteria, we evaluate how both the mandate and published statements are calibrated to each stakeholder class. The findings show that while structural compliance is widespread, transparency calibration is uneven. Criteria serving high-control stakeholders are consistently realised, whereas criteria most critical for high-risk, low-control stakeholders are fewer and less substantively addressed. We conceptualise this as the Transparency Illusion: a condition in which transparency appears satisfied through compliant artefacts yet remains unevenly calibrated to stakeholders bearing the greatest exposure to AI-supported decisions. The study frames transparency as a stakeholder-calibrated validation problem, demonstrating that artefact-level compliance does not constitute requirements validation in this context.

Institutions for the Post-Scarcity of Judgment

Each major technological revolution inverts a particular scarcity and rebuilds institutions around the shift. The near-consensus diagnosis of the AI revolution holds that AI collapses the cost of prediction while judgment remains scarce. This Opinion argues the inversion has now flipped: competent-looking judgment (selecting, ranking, attributing, certifying) is produced at scale and at marginal cost approaching zero, and four complements become scarce: verified signal, legitimacy, authentic provenance, and integration capacity (the community's tolerance for delegated cognition). Because judgment is the substance of institutions, the institutions built to manufacture legitimate judgment (courts, journals, licensing bodies, legislatures) now compete with the technology for the same functional role. The piece traces the pattern across scientific institutions, professional licensing, intellectual property, democratic legitimacy, and foundation-model concentration, and closes with a three-move agenda: reframe AI policy as institutional redesign, build provenance and verification as commons, and develop the formal apparatus for institutional composition under strategic agents.
